Regardless of what is written in the prevailing law, the public construction works according to the bids invited at the international level can be completed by the following construction professionals in the following cases:-
(a) Construction business with 100 percent Nepali citizens or licensed construction business in joint venture with foreign construction business with at least 50 percent Nepali citizens or construction business entering into a joint investment agreement with foreign construction business with at least 50 percent Nepali citizens share in the bid. Even if the contract number is up to seven and a half percent higher than the total contract number mentioned in the bid submitted by the foreign construction businessmen, such a bid will be submitted.
(b) The total number of contracts mentioned in the bid by a licensed construction professional in a joint venture with a foreign construction professional with a share of at least twenty-five percent Nepali citizens or a construction professional entering into a joint investment agreement with a foreign construction professional having at least twenty-five percent Nepali citizens share in the bid submitted by the foreign construction professional. To submit such bid even if it is more than five percent above the mentioned total contract mark.
(2) Public construction works worth up to six million rupees should be done by Nepalese construction professionals.
